NOTICE OF PUBLIC HEARING ON AMENDMENT TO ZONING MAP
NOTICE IS HEREBY GIVEN THAT THE AVILLA PLAN COMMISSION will hold a Public Hearing on a proposed amendment to the Zoning Ordinance of the Town of Avilla, Indiana. Said Public Hearing will be held on the 6 th day of September, 2023 at 6:00 pm in the Town Hall, 108 S. Main Street, Avilla, Indiana. The petitioner, DNM, Inc. is requesting the zoning classification of the following described property be changed from the I-1 (Light Industrial) district to the R-2(Low Density Residential) District:
The property is part of the lands of DNM, Inc. being described in Document # 160100032 begin situated in the Southeast Quarter of Section 35, Township 34 North, Range 11 East of the Second Principal Meridan, Allen County, Indiana, and is more particularly described as follows:
Commencing at a Harrison Monument monumenting the Southwest corner of the Southwest Quarter of Section 35, Township 34 North, Range 11 East; thence North 89 Degrees, 42 minutes 14 seconds East (All bearings are based upon the Indiana East (1301) State Plane Coordinate System via the INCORS network), on the South line of said Southwest Quarter, a distance of 558.51 feet to a mag nail with an identification washer stamped “ANDERSON FIRM #29A” monumenting the Southeast corner of the land described in Document #221000269 being the POINT OF BEGNNING for the lands herein described; thence continuing North 89 degrees 42 minutes 14 seconds East, on said South line, a distance of 322.67 feet to a mag nail with an identification washer stamped “ANDERSON FIRM #29A” thence North 00 Degrees 17 minutes 46 seconds West a distance of 270.00 feet to a 5/8” rebar with an orange identification cap stamped “ANDERSON FIRM #29A”; thence South 89 degrees 42 minutes 14 seconds West a distance of 322.67 feet to a 5/8” rebar with an identification cap stamped “Renkenberger” monumenting the Northeast corner of the lands described in Document #221000269; thence South 00 degrees 17 minutes 46 seconds East, on the East line of said lands, a distance of 270.00 feet to the Point of Beginning, containing 2.00 acres of land, more or less, subject to all legal right-of-way and easements of record.
The Common location of this parcel is east of 10033 East Baseline Road, Avilla, Indiana.
Interested persons desiring to present their views upon the proposed amendment, either in writing or in person, will be given the opportunity to be heard at the above-mentioned time and place. Written suggestions or objections to the provisions of said amendment may be filed with the Secretary of the Plan Commission before said meeting and will be heard by the Plan Commission at the time and place specified. Said hearing may be continued from time to time as may be necessary. Said meeting is open to the public.
